Terms of Service

1. Service Description

VibeGen is an AI-powered software-as-a-service (SaaS) platform that helps indie hackers and developers generate project ideas, market research, product requirements documents (PRDs), and implementation task lists. The service is provided by MB "Ponas Obuolys", Lithuania, EU.

By creating an account or using VibeGen, you agree to these Terms of Service. If you do not agree, do not use the service.

2. User Accounts and Responsibilities

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to use VibeGen.
• You are responsible for all activity that occurs under your account.
• You agree not to share your account with others or create multiple accounts.

3. Subscriptions and Credits

VibeGen operates on a credit-based system with subscription tiers:

• Free tier: limited monthly credits at no cost.
• Paid tiers (Starter, Pro, Team): monthly subscriptions providing higher credit allowances and additional features. Billed monthly via Stripe.
• Credit packages: one-time purchases of additional credits that do not expire.

Each AI action (idea generation, PRD creation, task generation, market research, validation) costs a specified number of credits. Credit costs are displayed before each action.

No refunds: due to the nature of AI-generated content, all purchases (subscriptions and credit packages) are non-refundable. You may cancel your subscription at any time, and you will retain access to your current plan benefits until the end of the billing period.

4. Intellectual Property

Your content: you retain ownership of all content generated through VibeGen, including ideas, PRDs, task lists, and research results. You may use this content for any purpose, including commercial projects.

Our service: the VibeGen platform, including its design, code, and branding, is owned by VibeGen. You may not copy, modify, or redistribute any part of the platform.

Community content: when you publish an idea to the community, its title and elevator pitch become visible to other users. Your PRDs, research, and tasks remain private.

5. AI-Generated Content Disclaimer

All content generated by VibeGen is produced by AI models and is provided "as is" without any guarantees of accuracy, completeness, or fitness for a particular purpose. Specifically:

• Market research data, competitor analysis, and revenue estimates are AI-generated approximations, not verified market data.
• Idea validation results are simulated customer feedback, not real user research.
• PRDs and task lists are starting points that require human review and adaptation.
• We do not guarantee that generated ideas are unique, patentable, or free from existing intellectual property claims.

You are solely responsible for evaluating and acting on any AI-generated content.

6. Prohibited Use

You agree not to use VibeGen to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to circumvent credit limits, rate limits, or subscription restrictions.
• Scrape, crawl, or use automated tools to extract data from the platform.
• Interfere with the security or integrity of the service.
• Resell or redistribute AI-generated content as a competing service.
• Impersonate another person or misrepresent your identity.

7. Limitation of Liability

To the maximum extent permitted by applicable law, VibeGen and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claim arising from these terms or your use of the service shall not exceed the amount you paid to VibeGen in the 12 months preceding the claim.

8. Termination

• You may delete your account at any time through Settings. A 30-day grace period applies before permanent deletion.
• We may suspend or terminate your account if you violate these terms, with or without notice.
• Upon termination, your right to use the service ceases immediately. Any remaining credits or subscription time are forfeited.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Lithuania and applicable European Union regulations. Any disputes shall be resolved in the courts of Vilnius, Lithuania, without prejudice to your rights under applicable consumer protection laws of your country of residence within the EU.

10. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated via email or an in-app notice. Your continued use of VibeGen after changes constitutes acceptance of the updated terms.
